MarineLink Marketplace Terms & Conditions
Welcome to MarineLink Marketplace. MarineLink Marketplace is an online listing platform operated by New Wave Media that allows sellers to list marine, maritime, offshore, shipbuilding, equipment, vessel, component, service, and related commercial items for sale, lease, auction, promotion, or inquiry.
By accessing or using MarineLink Marketplace, creating an account, submitting a listing, responding to a listing, or contacting a seller through the platform, you agree to these Terms & Conditions.
1. Marketplace Role
MarineLink Marketplace provides a platform for sellers and buyers to connect. MarineLink Marketplace is not a party to any transaction between buyers and sellers unless expressly stated in writing.
MarineLink Marketplace does not own, inspect, certify, guarantee, warrant, broker, escrow, ship, finance, or otherwise participate in the sale, purchase, lease, charter, transfer, or delivery of any listed item.
All negotiations, inspections, due diligence, payment arrangements, taxes, title transfer, delivery, removal, export/import compliance, and transaction terms are solely between the buyer and seller.
2. Seller Responsibility
Sellers are fully responsible for the accuracy, completeness, legality, availability, ownership rights, pricing, descriptions, specifications, photos, documents, and claims included in their listings.
- The seller has the legal right to list, sell, lease, promote, or otherwise offer the item or service.
- The listing does not infringe any third-party rights.
- The listing does not contain false, misleading, fraudulent, defamatory, obscene, unlawful, or inappropriate content.
- Any photos, documents, specifications, manuals, logos, trademarks, or other materials submitted may lawfully be used in connection with the listing.
- The listing complies with all applicable laws, rules, and regulations.
3. Buyer Responsibility
Buyers and prospective buyers are responsible for conducting their own due diligence before entering into any transaction. Buyers should independently verify condition, specifications, ownership, title, liens, regulatory status, certifications, inspection records, maintenance history, pricing, location, availability, and suitability for intended use.
MarineLink Marketplace does not guarantee the accuracy of listings or the performance, condition, legality, availability, or value of any listed item.
4. Listing Content
Users may not post content that is libelous, defamatory, obscene, abusive, fraudulent, misleading, unlawful, discriminatory, threatening, invasive of privacy, infringing, or otherwise inappropriate.
Users may not post content that degrades others on the basis of gender, race, class, ethnicity, national origin, religion, sexual orientation, disability, age, veteran status, or any other protected classification. Language intended to intimidate, harass, threaten, or incite violence will not be tolerated.
5. Listing Approval and Removal
Listings may be subject to review and approval before publication. MarineLink Marketplace may reject, suspend, edit, remove, expire, or unpublish any listing in its sole discretion.
6. Fees, Billing, and Launch Promotions
Certain listings, featured placements, advertising packages, auction programs, renewal options, subscription features, or enhanced visibility options may require payment. During a launch, beta, promotional, trial, or introductory period, MarineLink Marketplace may provide complimentary, discounted, or comped listings at its discretion. Comped or free launch participation does not guarantee future free listings, advertising, renewals, subscriptions, commissions, or promotional placement.
7. Inquiries and Communications
MarineLink Marketplace may provide forms, links, email routing, dashboards, or other tools to help buyers and sellers communicate. Sellers are responsible for responding to inquiries and managing their own communications with prospective buyers.
8. No Warranty
MarineLink Marketplace is provided on an “as is” and “as available” basis and makes no warranties of accuracy, completeness, reliability, merchantability, fitness for a particular purpose, title, non-infringement, availability, security, uninterrupted service, or error-free operation.
9. Errors, Omissions, and Availability
MarineLink Marketplace is not responsible for errors, omissions, outdated information, incorrect specifications, pricing mistakes, typographical errors, incomplete descriptions, inaccurate photos, missing documents, broken links, downtime, technical issues, or data loss.
10. Limitation of Liability
To the fullest extent permitted by law, MarineLink Marketplace, New Wave Media, its affiliates, officers, employees, contractors, representatives, and partners shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or relating to use of the Marketplace, listings, inquiries, communications, transactions, or disputes between buyers and sellers.
11. User Accounts
Users are responsible for maintaining the confidentiality of login credentials and for all activity under their account. MarineLink Marketplace may suspend or terminate accounts that are inactive, fraudulent, abusive, misleading, unlawful, or otherwise inconsistent with these Terms.
12. Intellectual Property and Listing License
All Marketplace design, branding, text, layout, software, databases, logos, graphics, and platform content are owned by or licensed to MarineLink Marketplace, New Wave Media, or their respective rights holders.
By submitting content to MarineLink Marketplace, users grant MarineLink Marketplace and New Wave Media a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, edit, format, adapt, promote, and publish such content in connection with the Marketplace, MarineLink.com, related websites, newsletters, advertising programs, search indexing, social promotion, sales materials, and associated marketing activities.
This license applies to listing titles, descriptions, specifications, photos, documents, manuals, logos, trademarks, seller-provided text, and other materials submitted by or on behalf of the seller.
Users represent and warrant that they have all rights, permissions, licenses, approvals, and authority necessary to submit the content and grant this license.
13. Search Engines and Public Visibility
Published listings may be publicly visible and may be indexed by search engines. Listing titles, descriptions, photos, seller information, and related content may appear in search results, promotional placements, newsletters, social media, or other public-facing channels.
14. Prohibited Uses
Users may not submit false, misleading, fraudulent, or unlawful listings; scrape or misuse Marketplace data; send spam; upload harmful code; impersonate another person or company; circumvent billing, approval, security, or access controls; or violate export control, sanctions, trade, safety, environmental, maritime, or other applicable laws.
15. Third-Party Links
Listings may contain links to seller websites or other third-party resources. MarineLink Marketplace is not responsible for third-party websites, content, products, services, representations, privacy practices, or security.
16. Disputes Between Buyers and Sellers
MarineLink Marketplace is not responsible for resolving disputes between buyers and sellers. Any disputes regarding payment, delivery, title, condition, inspection, performance, availability, misrepresentation, warranties, or transaction terms must be resolved directly between the parties involved.
17. Indemnification
Each user, seller, buyer, advertiser, and account holder agrees to defend, indemnify, and hold harmless MarineLink Marketplace, New Wave Media, its affiliates, officers, directors, employees, contractors, representatives, partners, successors, and assigns from and against any claims, demands, damages, losses, liabilities, costs, expenses, judgments, settlements, penalties, and attorney fees arising out of or related to any listing, seller content, buyer inquiry, offer, sale, purchase, lease, auction, transaction, dispute, inaccurate or infringing content, IP claim, title issue, delivery issue, inspection issue, export/import issue, or violation of these Terms or applicable law.
18. Privacy
Use of MarineLink Marketplace is also subject to the MarineLink Marketplace Privacy Policy.
19. Changes to These Terms
MarineLink Marketplace may update these Terms & Conditions from time to time. Updated terms will be posted on this page with a revised “Last updated” date. Continued use of the Marketplace after changes are posted constitutes acceptance of the updated terms.
